Conditions of purchase
Limited Warranty
The warranty and return policy for all products sold hereunder (the “Products”) are determined by the original manufacturer or supplier. All products sold by Le Groupe JSV Inc. Ltée (“Constructions Fasteners”) are warranted to the extent of the manufacturer’s or supplier’s warranty and only to purchasers (“Purchasers”) for resale or for use in their business in Canada.
Products are warranted against defects in workmanship and materials only under each manufacturer's warranty policy. Manufacturers of certain Products, such as fastening hardware, do not have a warranty period.
Any part that is found by Le Groupe JSV Inc. to be defective in material or workmanship and returned to a Le Groupe JSV Inc. branch or to an authorized service center as designated by Le Groupe JSV Inc. with transportation charges prepaid, will be replaced at the sole discretion of Le Groupe JSV Inc., as the Buyer's exclusive remedy.
Disclaimer of Warranty. JSV Group Inc. has made diligent efforts to illustrate and describe the Products in its catalog as accurately as possible; however, these illustrations and descriptions are provided for identification purposes only and do not imply any express or implied warranty or condition that the Products are merchantable or fit for any particular purpose or that the Products will necessarily conform to the illustrations or descriptions. Limitation of Liability. Any liability for indirect, special, exemplary, punitive, or incidental damages is expressly disclaimed by Le Groupe JSV Inc. Le Groupe JSV Inc. assumes no liability for any damage, loss, or cause of action (whether in contract, tort, or otherwise) in excess of the purchase price paid by the Buyer for the product in question.
Prompt Resolution. Le Groupe JSV Inc. will make a good faith effort to promptly correct or make other changes to a Product that is proven to be defective within the warranty period. Before returning a Product, write or call the Le Groupe JSV Inc. store where it was purchased, providing the date and number of the original invoice, and describing the defect. The Le Groupe JSV Inc. branch will provide you with instructions on how to return the Product.
Suitable Product. Many provinces and territories have laws, codes, and regulations that govern the sale, construction, installation, or use of products for certain purposes, and these laws may differ from those in neighboring jurisdictions. While Le Groupe JSV Inc. strives to ensure that its products comply with these codes, it cannot guarantee compliance and cannot be held responsible for the manner in which the Products are installed or used. Before purchasing and using a Product, please review the Product and the applicable national, provincial, and local laws, codes, and regulations and ensure that the Product, its installation, and its use comply with them.
Hazardous Materials Information. For the information of Buyers, Le Groupe JSV Inc. has obtained a Safety Data Sheet (“SDS”) for all “controlled products” within the meaning of the Hazardous Products Act (Canada) and its regulations, with respect to the products offered for sale by Le Groupe JSV Inc. The SDS in question complies with the occupational health and safety legislation regulating “hazardous materials” and its regulations implementing the Workplace Hazardous Materials Information System. These SDS are available upon request. The information and recommendations contained in the applicable SDS provided and prepared by the manufacturer are believed to be accurate and reliable. However, Le Groupe JSV Inc. does not provide any warranty as to the accuracy or reliability of the information or the relevance of the recommendations. Le Groupe JSV Inc. disclaims all liability to any user in this regard.

As a service, Le Groupe JSV Inc. will obtain copies of warranties from the warrantor and provide them free of charge to consumers who request them. General conditions of sale and transport
Sales Policy
Terms and Conditions. By placing an order, the Buyer accepts the terms and conditions of Le Groupe JSV Inc., including the limited warranty, which may vary from time to time and change without notice. WHOLESALE ONLY JSV Group Inc. offers its Products for sale to Buyers for business use or consumption in Canada, and only in accordance with the manufacturer's specifications, requirements, recommendations, and warranties. By placing an order, the Buyer acknowledges that it is a purchase for business purposes and not for consumption. Buyers may be required to provide business identification. Possession of a catalog does not constitute a right to purchase from JSV Group Inc.
Prices displayed are in Canadian dollars and are subject to change without notice. Quotes for large purchases can be prepared upon request. For more information, contact your local Le Groupe JSV Inc. branch or a representative.
SALES TAXES. JSV Group Inc. must pay applicable goods and services taxes and provincial sales taxes on items for which a tax exemption certificate has not been provided. When ordering, please provide any valid exemption certificate.
PAYMENT TERMS. For Buyers with established credit, the terms are net thirty (30) days from the delivery date. If credit is not established, please include payment with the order or purchase with Visa, MasterCard, or American Express. All payments must be in Canadian dollars. JSV Group Inc. reserves the right to withhold and deduct any amount due. If the Buyer fails to make payment within thirty (30) days, JSV Group Inc. may withhold delivery until payment is made or may, at its option, cancel all or part of any order not yet delivered. Interest of 2% per month will be charged on overdue accounts (26.82% compound annual rate).
CREDIT BALANCE. The Buyer agrees that any credit balance issued will be used one (1) year after being issued. If the credit balance is not used or claimed within one (1) year, the remaining balance may be cancelled and Le Groupe JSV Inc. will have no further liability in this regard.
Product Availability and Special Orders. Products are subject to availability at the time of order. When special ordering, some items must meet minimum quantity requirements specified by the manufacturer and may require additional delivery time.
When products purchased from Le Groupe JSV Inc. are exported, the Buyer is solely responsible for the export of the Products from Canada and the import into the destination countries, as well as for compliance with applicable regulations, which include, but are not limited to, Canadian export control laws, rules and regulations. Under no circumstances will Le Groupe JSV Inc. be the exporter. The Buyer may not export products purchased from Le Groupe JSV Inc. without first obtaining all necessary written authorizations, permits and authorizations and completing its formalities required by the laws, rules and regulations. The Buyer represents and warrants that it will not export or divert the Products to any country or person to whom export from Canada is prohibited under applicable laws, rules and regulations.
Force Majeure. JSV Group Inc. shall not be liable for any damages, costs or losses suffered by the buyer or for any delay, failure to deliver or failure to perform attributable to an event beyond its control, such as force majeure, intervention or non-intervention by a state, government or other public authority, confiscation, armed conflict, blockade or blockade, insurrection, invasion, quarantine, riot, sabotage, fire, flood, explosion, epidemic, landslide, lightning, earthquake, accident, strike, lockout, work stoppage or slowdown, embargo, power outage or any delay or failure affecting products, materials, manufacturing or transportation.
Shipping Policy. Shipping is FOB shipping point. JSV Group Inc. reserves the right to add shipping and handling charges, particularly for small orders, urgent or rural deliveries, or orders requiring special handling.
Title and Risk of Loss Title and risk of loss for the Products ordered are transferred to the Buyer upon shipment by Le Groupe JSV Inc. If the products are damaged during transport, the Buyer must file a claim with the carrier. If the products remain undeliverable for two days, the carrier will return them to Le Groupe JSV Inc. In this case, additional charges may apply.
Return Policy. All cancellations and returns must be authorized by Le Groupe JSV Inc. (at its discretion) and accompanied by proof of purchase, and may be subject to a restocking fee or other charges. Any return due to a shipping error, damage, or loss must be immediately reported to Le Groupe JSV Inc. In cases of returns not related to damage or loss during delivery, the product must be returned within 30 days of shipment, in its original packaging, and in a resalable condition.
Assignment. The buyer may not assign an order or any right therein without the written consent of Le Groupe JSV inc. In the event of an assignment or attempted assignment, Le Groupe JSV inc. may cancel the order upon notice to the buyer.
